This Liability Waiver, Release, and Assumption of Risk Agreement (“Agreement”) is entered into between L.Y.R.I.C. Charters (“Company”) and the undersigned booking guest (“Participant”), who signs on behalf of all guests in their party.
By signing this document, the Participant acknowledges and agrees to the following:
1. Assumption of Risk
I acknowledge that participating in a recreational boating charter involves inherent risks, including but not limited to:
Slips, falls, and injuries
Weather conditions, waves, and water movement
Boarding/disembarking risks
Cuts, bruises, sprains, drowning
Injuries related to alcohol consumption
Injuries during swimming or water activities
Equipment malfunction or unexpected vessel movement
I understand and agree that I voluntarily assume all risks, known or unknown, associated with my participation and the participation of all guests in my booking.
2. Release of Liability
To the fullest extent permitted by law, I hereby RELEASE, WAIVE, and DISCHARGE L.Y.R.I.C. Charters, its owners, employees, captains, agents, and contractors from any and all liability, claims, demands, or causes of action arising from:
This includes claims related to ordinary negligence, but does NOT waive liability for gross negligence or intentional misconduct, as prohibited by law.
3. Alcohol & Behavior
I understand that:
Alcohol is permitted ONLY for guests 21+
Intoxicated or unsafe behavior may result in termination of the charter with no refund
L.Y.R.I.C. Charters is not responsible for injuries or incidents resulting from alcohol consumption
Illegal drugs are strictly prohibited
I accept responsibility for the behavior and actions of all guests in my party.
4. Swimming & Water Activities
I acknowledge that:
Swimming is permitted only at the Captain’s discretion
All minors must wear life jackets
Swimming carries risks including drowning, currents, and underwater hazards
I am fully responsible for ensuring guests follow all safety instructions
I release L.Y.R.I.C. Charters from any injury or incident that occurs while swimming or participating in water activities.
5. Compliance With Captain’s Instructions
I agree that:
The Captain has full authority over safety at all times
Guests must comply immediately with all instructions
Unsafe conduct may result in termination of the charter without refund
The Captain may end swimming or alter routes due to weather or risk
6. Damage & Cleaning Fees
I agree to pay for:
Any damage to the vessel or equipment caused by me or my guests
Excessive cleaning fees if required (vomit, spilled food/drinks, etc.)
Lost, broken, or stolen equipment caused by my party
The booking guest accepts full financial responsibility for all guests.
7. Photo & Media Release (Optional)
I grant permission for photos or videos taken during the charter to be used by L.Y.R.I.C. Charters for promotional or social media purposes unless I notify the company otherwise prior to boarding.
8. Representation of Authority
I affirm that:
I am signing on behalf of ALL guests in my group, including minors
I have the legal authority to do so
All guests are bound by this waiver
9. Governing Law
This Agreement is governed by the laws of the State of North Carolina / South Carolina (choose based on primary operations).Any disputes shall be resolved in the county where the company operates.
10. Acknowledgment
By signing below, I acknowledge that:
I have read and understood this waiver
I am voluntarily giving up legal rights
I assume full responsibility for all guests in my booking
Cancellation Policy
• 50% Deposit Nonrefundable
• Weather cancellations made by L.Y.R.I.C. Charters are fully refundable or can be rescheduled based on availability. Pricing may vary based on Holidays and Special Event Dates.
Weather Policy
Safety comes first.Storms, lightning, or dangerous conditions = reschedule or refund. Charters RESUME in light rain. Will defer to weather forecast on weather app.
Safety Rules
Captain’s instructions must be followed at all times
No glass bottles
No standing or sitting on rails
No diving off the boat
No smoking inside cabins; smoking permitted on swim platform
No standing on the seats
Damage Policy
Guests are responsible for any accidental or intentional damage caused to the vessel or equipment.
Behavior Policy
We reserve the right to end the charter early with no refund for unsafe or inappropriate behavior.
